Homelike Sponsored Listings - Subscription Terms of Service

1. Subscription:

1.1. Homelike Sponsored Listings enable Providers (as defined in Homelike’s standard Terms & Conditions, see here) to acquire promoted listing space for their Accommodation on Homelike’s Platform on a subscription basis.  Depending on the subscription, the Provider books one or multiple advertising space(s) for a city. Advertising space means that the listing is pushed to the top of the search results page – based on the logic described below – for the city selected by the Customer in the search process. A Sponsored Listing will be marked or otherwise indicated as such to the Customer. Homelike displays a limited number of advertising spaces per city. A Sponsored Listing will be displayed at the top of the search page only if it meets other filter criteria the Customer may have selected. Homelike does not guarantee reach or number of impressions and sponsored listings do not represent a fixed placement. Depending on the number advertising spaces available and the number of subscriptions bought for a city, Sponsored Listings may be rotated across the respective available advertising spaces. 

1.2 The subscription starts from the day you subscribe. It may take a few hours until your apartment(s) start(s) being promoted on the website, subject to the terms described above and any filter criteria the Customer may select. 

1.3 Your Homelike Sponsored Listings subscription will continue until canceled. To use Sponsored Listings you must provide us with one Payment Method. “Payment Method” means a current, valid and by Homelike accepted method of payment, as may be updated from time to time. Unless you cancel your subscription before your billing date, you authorize us to charge the Subscription Fee for the next billing period to your Payment Method (see “Cancellation” below).

1.4 Homelike may offer different subscription plans for Sponsored Listings.

 

2. Billing and Cancellation:

2.1 Subscription Fee: Homelike charges a monthly Subscription Fee for our Sponsored Listings service. The Subscription Fee for your plan will be displayed to you upon plan selection and before signing up to a Sponsored Listings plan. By clicking on the button “book now at cost” you agree to the displayed price and thereby submit an offer to take out a subscription. This is usually automatically accepted by Homelike afterwards. The contract for the subscription only comes into effect upon confirmation by Homelike. 

2.2 Billing: The Subscription Fee for Sponsored Listings will be charged (recurrently, if applicable) to your Payment Method on the specific payment date indicated on the  “Billing” page of the Homelike-Dashboard. The length of your billing period will depend on the type of subscription plan that you chose when you signed up for Sponsored Listings. In some cases your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid subscription began on a day not contained in a given month. Visit the app.thehomelike.com website and click on the “Billing” tab on the “Promote” page to see your next payment date. 

2.3 Payment method: To use the Sponsored Listings service you must provide one online payment method. You authorize Homelike to charge the payment method associated with your subscription plan until your subscription is canceled. 

2.4 Missing payments: If a payment is not successfully settled due to expiration, insufficient funds, or any other reason, and you do not cancel your subscription, Homelike may suspend your access to the Sponsored Listings until Homelike has successfully charged a valid payment method. In case your payment method fails or is rejected, you remain liable to pay for any open invoice amounts or Subscription Fees. Homelike reserves the right to charge late payment fees and interest – in line with statutory regulation –  if invoices are not settled. 

2.5 Updating your Payment Methods: You can update your Payment Methods by going to the “Billing” tab in the Homelike-Dashboard. Homelike may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).

2.6 Cancellation: You can cancel your Sponsored Listings subscription at any time with a notice period of one day prior to the end of your billing period (see point 2.2). In case of a subscription cancellation, you will continue to have access to Sponsored Listings until the end of your billing period. Payments are non-refundable and Homelike does not provide refunds or credits for any partial subscription periods or unused Sponsored Listings. Homelike reserves the right to cancel the subscription at any time for good cause. Homelike is also entitled to ordinary cancellation with a notice period of one day to the end of a billing period. Cancellations can be made online in the Homelike system, in writing or by email.

2.7 Changes to subscription plans: Homelike reserves the right to introduce new subscriptions and fees at any time. Existing plans will not be affected. Homelike also reserves the right to discontinue or cancel existing plans without replacement. Homelike will notify you of this at least one month in advance and, in any case, respecting any ordinary cancellation period, see “Cancellation” above.

2.8 Exclusions: Sponsored Listings are a way to promote your Accommodation via Homelike and do not imply a guarantee to receive requests or bookings. Customers will only see your Sponsored Listing when their search criteria match your apartment with regards to availability, number of guests, etc. Sponsored Listings are only available for Accommodation profile(s) that have the status “verified” and “online”.

 

3. Additional regulations for consumers: If you conclude a contract for sponsored listings with Homelike as a consumer, the following applies:

Right of revocation

You have the right to withdraw from this contract within fourteen days without giving any reason.

The revocation period is fourteen days from the date of conclusion of the contract.

To exercise the right to revocation, you must inform us (Homelike Internet GmbH, Brückenstr. 2, 50667 Cologne, Germany) of your decision to revoke this contract by a clear statement (e.g. a letter sent by post or e-mail). You can use the template cancellation form (link), but this is not mandatory.

To meet the revocation deadline, it is sufficient for you to send your notification of exercising your right of revocation before the revocation period expires.

Consequences of revocation

If you revoke this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.


If you have requested that the services should commence during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you inform us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.

4. Other / Homelike T&C: In addition to the above provisions, the T&C of Homelike (Link) shall apply. In the event of contradictions, the provisions of these Sponsored Listing T&C shall take precedence over the general T&C of Homelike. The English version of these Sponsored Listings Terms of Service are a translation of the German version and in case of any contradiction, the German version precedes.
